Spain Enacts Royal Decree Emphasizing on Heated Tobacco Products

January 17, 2024

The Royal Decree 47/2024,  adjusts the existing restrictions on tobacco products in Spain, integrating the amendments indicated in Delegated Directive (EU) 2022/2100 of the Commission. This amendment largely addresses heated tobacco products, including the restriction of characteristic scents or flavorings in their components and changes to labeling regulations. The decision broadens the prohibition on selling tobacco products with distinct aromas or flavorings, eliminating exemptions for instructive messaging and combined health warnings. It establishes the definition of heated tobacco products and repeals existing exemptions. The decree adheres to good regulatory standards, focusing on necessity and effectiveness, transparency, and public consultation.
