U.S. EPA Proposes “Technology Transition” Rule under the AIM Act to Further Restrict Use of HFCs

The American Innovation and Manufacturing Act, which was passed on December 27, 2020, contains a number of provisions that the U.S. Environmental Protection Agency is proposing to implement through regulations. This rulemaking seeks to address a number of issues related to the efficient implementation of the American Innovation and Manufacturing Act, including: limiting the use of hydrofluorocarbons in particular industries or subindustries; establishing a procedure for submitting technology transitions petitions; establishing recordkeeping and reporting requirements. Part of the petitions approved on October 7, 2021, and September 19, 2022, would be addressed by the proposed restrictions on the use of hydrofluorocarbons. The United States Environmental Protection Agency is also looking for advance information on a few subjects that could be useful in developing a future proposed rule, such as limitations on the use of hydrofluorocarbons for a few other industries and subindustries and a third-party auditing programme to confirm the ingredients used in products.
