Utah adopts Senate Bill 61, which modifies provisions on electronic cigarettes, on March 12, 2024. It redefines several tobacco-related words and forbids the sale of flavored nicotine vapor products, with the exception of mint, menthol, and tobacco flavors, beginning January 1, 2025. It establishes a maximum nicotine dosage of 4% (40 mg/mL) and requires premarket FDA authorization or a pending FDA application for all e-cigarette products. Synthetic nicotine products must be taken off the market by January 1, 2025, unless they have gained FDA marketing approval. It also establishes a registry for electronic cigarette items. The bill becomes effective on 1 July 2024.
