Chile Implements Stricter Tobacco Regulations in Effort to Curb Usage and Protect Public Health

Chile published a comprehensive law on January 4, 2024, aimed at regulating tobacco-related products, including electronic nicotine delivery systems (ENDS) and electronic non-nicotine systems (SESN). This law changes Law No. 19,419 to include warmed tobacco products, ENDS, SESN, and vaping liquids.

 The law broadens the scope of tobacco laws and establishes new categories such ENDS, SESN, and their accessories. SESN and ENDS advertising is subject to stricter controls, with the Ministry of Health able to set particular limitations.Tobacco products, ENDS, SESN, and accessories cannot be sold, distributed, or delivered free of charge to children under the age of 18, nor can vending machines for these goods be installed in health facilities. Tobacco goods, ENDS, SESN, and similar items cannot be compensated or distributed for free.

 Labeling requirements for ENDS, SESN, and vaping liquids have been created, including addiction warnings and age limitations.
 Tobacco use or vaping, ENDS, and SESN are all forbidden in public and private settings, with the exception of medicinal SESN with a medical prescription. Noncompliance is penalized with specific consequences, including fines for breaches such as sales to minors and unlawful advertising. To prevent minors from tampering, ENDS, SESN, and vaping liquids must meet specific packaging criteria.
